Introduction

GreySun Technologies, Inc. (“Company” or “We”) respect your privacy and are committed to protecting it through our compliance with this policy. This policy describes: 

  • The types of information we may collect or that you may provide when you download, access, or use the GreySun App (the “Application”).

  • Our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies only to information we collect in this Application, in email, text, and other electronic communications sent through or in connection with this Application.

This policy DOES NOT apply to information that:

  • We collect offline or on any other Company apps or websites, including websites you may access through this Application. 

  • You provide to or is collected by any third party. 

These other third parties may have their own privacy policies, which we encourage you to read before providing information on or through them.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, register with, or use this Application. By downloading, registering with, or using this Application, you agree to this privacy policy. This policy may change from time to time. Your continued use of this Application after we revise this policy means you accept those changes, so please check the policy periodically for updates. 

Users Under the Age of 18

The Application is restricted to individuals who are 18 years of age or older. We do not permit individuals under the age of 18 on our Application. If we learn we have collected or received personal information from a user under the age of 18, we will close their account and take steps to delete their information. Information We Collect and How We Collect It

We collect information from and about users of our Application:

  • Directly from you when you provide it to us.

  • Automatically when you use the Application. 

Information You Provide to Us

When you download, register with, or use this Application, we may ask you to provide information:

  • By which you may be personally identified, such as name, postal address, email address, and telephone number (“Personal Information”).

  • That is about you but individually does not identify you, such as age, gender, and weight.

This information includes: 

  • Information that you provide by filling in forms in the Application. This includes information provided at the time of registering to use the Application and posting material. We may also ask you for information when you report a problem with the Application.

  • Records and copies of your correspondence (including email addresses and phone numbers), if you contact us.

  • You may also provide information submitted for publication or display (“Posted”) on public areas of the Application (collectively, “User Contributions”). Your User Contributions are Posted and transmitted to others at your own risk. Although you may set certain privacy settings for such information by logging into your account profile, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of third parties with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons. User Contributions may include information associated with the use of our hardware such as device status, and logs of breathalyzer activity.

  • Names and email addresses associated with the invitees you request to engage with the Application, as well as the invitees’ use of the Application.

Automatic Information Collection 

When you download, access, and use the Application, it may use technology to automatically collect:

  • Usage Details. When you access and use the Application, we may automatically collect certain details of your access to and use of the Application, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the Application. 

  • Device Information. We may collect information about your mobile device and internet connection, including the device’s unique device identifier, IP address, operating system, browser type, mobile network information, and the device’s telephone number.

  • Stored Information and Files. The Application also may access metadata and other information associated with other files stored on your device. This may include, for example, personal contacts and address book information.

  • Location Information. This Application collects real-time information about the location of your device. We may collect information about your precise location that includes methods such as GPS signals.

If you do not want us to collect this information, do not download the Application or delete it from your device. Note, however, that opting out of the Application’s collection of location information will disable its location-based features.

Information Collection Technologies 

The technologies we use for automatic information collection may include:

  • Cookies (or mobile cookies). A cookie is a small file placed on your smartphone. It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your smartphone. However, if you select this setting you may be unable to access certain parts of our Application. 

  • Web Beacons. Pages of the Application and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related app statistics (for example, recording the popularity of certain app content and verifying system and server integrity).

Third-Party Information Collection

When you use the Application or its content, certain third parties may use automatic information collection technologies to collect information about you or your device. These third parties may include: 

  • Advertisers, ad networks, and ad servers.

  • Your mobile device manufacturer.

  • Your mobile service provider.

These third parties may use tracking technologies to collect information about you when you use this Application. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. 

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. 

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information, to:

  • Provide you with the Application and its contents, and any other information, products, or services that you request from us.

  • Fulfill any other purpose for which you provide it.

  • Carry out our obligations and enforce our rights arising from any contracts entered into between you and us.

  • Notify you when Application updates are available, and of changes to any products or services we offer or provide though it.

The usage information we collect helps us to improve our Application and to deliver a better and more personalized experience by enabling us to, for example:

  • Estimate our audience size and usage patterns.

  • Store information about your preferences, allowing us to customize our Application according to your individual interests.

  • Speed up your searches.

  • Recognize you when you use the Application.

We use location information we collect to facilitate the functionalities of the Application and GreyBand hardware devices. We may share information about your location with other users if you so choose, as well as with third-party rideshare apps, such as Lyft or Uber, to facilitate your use of those apps through our Application. We may also use your location information to provide, personalize, and improve our advertising services, ad targeting, and ad measurement. 

We may also use your information to contact you about our own and third parties’ goods and services that may be of interest to you.

We may use the information we collect to display advertisements to our advertisers’ target audiences. Even though we do not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual or device, without restriction. 

In addition, we may disclose personal information that we collect or you provide:

  • To our subsidiaries and affiliates.

  • To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.

  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of GreySun Technologies, Inc.’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by GreySun Technologies, Inc. about our Application users is among the assets transferred.

  • To third parties to market their products or services to you if you have not opted out of these disclosures. We contractually require these third parties to keep personal information confidential and use it only for the purposes for which we disclose it to them. 

  • To fulfill the purpose for which you provide it. 

  • For any other purpose disclosed by us when you provide the information.

  • With your consent.

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.

  • To enforce our rights arising from any contracts entered into between you and us, including the GreySun Technologies, Inc. Mobile Application End User License Agreement and GreySun Technologies, Inc. Mobile Application Terms of Use.

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of GreySun Technologies, Inc., our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

Your Choices About Our Collection, Use, and Disclosure of Your Information

We strive to provide you with choices regarding the personal information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of over your information. 

  • Tracking Technologies. You can choose whether or not to allow the Application to collect information through tracking technologies in the Application. If you disable, refuse, or block the use of tracking technologies, some parts of the Application may then be inaccessible or not function properly.

  • Location Information. You can choose whether or not to allow the Application to collect and use real-time information about your device’s location through the device’s privacy settings. If you block the use of location information, some parts of the Application may become inaccessible or not function properly.

We do not control third parties’ collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.

Accessing and Correcting Your Personal Information

You can review and change your personal information by logging into the Application and visiting your account profile page.

If you delete your User Contributions from the Application, copies of your User Contributions may remain viewable in cached and archived pages or might have been copied or stored by other Application users. Proper access and use of information provided on the Application, including User Contributions, is governed by our terms of use.

California Privacy Rights

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information. The following section applies solely to all visitors, users, and others who reside in the State of California. We adopt this notice to comply with the California Consumer Privacy Act of 2018 (CCPA), and any terms defined in the CCPA have the same meaning when used in this Policy.

We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household or device. This may include identifiers and personal information described in Cal. Civ. Code 1798.80(e) such as name, email addresses, phone numbers, postal addresses, mobile device identifiers, IP addresses, and GreyBand device hardware identifiers. It may also include age, gender, weight, internet activity information, and geolocation data. 

We use personal information to facilitate the Application’s functionality, GreyBand hardware devices’ functionality , customer service, and marketing and communications. We collect personal information through the Application, from customer support services, and directly from the consumer.

We may share your personal information by disclosing it to a third party for a business purpose. We only make these business purpose disclosures under written contracts that describe the purposes, require the recipient to keep the personal information confidential, and prohibit using the disclosed information for any purpose except performing the contract. 

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

You have the right to ask us to send you the following information:

  • The personal information we have collected from you.

  • The categories of sources for the personal information we collected about you.

  • Our business or commercial purpose for collecting that personal information.

  • The categories of third parties with whom we share that personal information.

  • The specific pieces of personal information we have collected about you.

  • You have the right to ask us to delete the personal information about you that we have collected.

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not deny you goods or services, charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties, provide you a different level or quality of goods or services, or suggest that you may receive a different price or rate for goods or services or a different level of goods or services.

This section applies only to individuals accessing and using the Application from within the European Union (“EU”) and the European Economic Area (“EEA”) and only if we collect through the Application any personal data that is subject to the GDPR (as defined in the GDPR; for the purposes of this section “Personal Data”). 

The legal grounds for our processing of your Personal Data are as follows:

  • You provided your consent (which you may withdraw at any time).

    • We rely on consent to the use of your Personal Data for the following types of data processing:

      • Marketing or promotional content.

      • Location information.

      • Personal Information and User Contributions.

      • The placement of cookies, web beacons, interest based advertising, or other tools by us or an affiliated third party to provide you with more relevant products or services.

  • It may be in our legitimate interests, including for administrative and security reasons, to process your Personal Data. 

    • Collecting and using your Personal Data to the extent necessary for our legitimate interests may include:

      • Ensuring the safety of our users.

      • Providing customer support.

      • Market research and other analysis.

      • Optimizing and developing our products and services.

  • Fulfillment of a contractual relationship with you may require the processing of your Personal Data.

  • We may have legal or regulatory obligations that require processing of your Personal Data. 

The GDPR provides you with certain rights regarding the collection, processing, and transfer of your Personal Data. These rights are as follows:

  • Right to Access. You have the right to know what Personal Data we collect from you and ask for a copy of your Personal Data.

  • Right to Rectification. You have the right to request that we correct Personal Data that you believe to be false or incomplete.

  • Right to Object to Processing. You have the right to object to processing of your Personal Data that is used for direct marketing purposes or for our “legitimate interests” (as defined in the GDPR).

  • Right to Erasure. You have the right to request that we erase the Personal Data we have collected about you in certain circumstances:

    • When we no longer need your Personal Data to carry out the purpose for which it was collected;

    • When you have withdrawn your consent to our use of your Personal Data;

    • When you have objected to our use of your Personal Data and your interests outweigh our interests in using it; 

    • When you believe we have processed your Personal Data unlawfully; and

    • When the Personal Data you are seeking erasure of was submitted by a child under 16 at the time of submission. 

      • Upon receiving a request from you to erase your Personal Data for any of these reasons, we will make our best effort to remove as much Personal Data as is legally allowed. If we are unable to comply with your request to erase Personal Data, we shall tell you in writing what Personal Data we continue to retain, for what reason, and for how long.

  • Right to Restrict Processing. You have the right to ask us to restrict the processing of your Personal Data under certain circumstances. You can request that we limit the use of your Personal Data for temporary purposes when we are reviewing an objection you have made to the accuracy or use of your Personal Data. You can also request that we limit the use of your Personal Data rather than delete it if we no longer need your Personal Data but you want us to keep it for legal purposes.

  • Right to Data Portability. You have the right to a copy of the Personal Data we collect about you in a structured, commonly used, and machine-readable format. You also have the right to request that such Personal Data be transmitted directly from us to another data controller when feasible.

  • Right to Withdraw Consent. You can withdraw your consent to our use of your Personal Data whose use is based on your consent at any time. This will not affect the lawfulness of processing based on consent before its withdrawal.

  • Right not to be Subject to a Decision Based Solely on Automated Processing. You have the right not to be subject to a decision based solely on automated means and may contact your local EU Data Protection Authority.

We will retain your Personal Data for as long as is necessary for the purposes described in this Privacy Policy. More specifically, the time we maintain your Personal Data depends on whether we need the Personal Data to provide the services, for a legitimate business purpose, or to comply with our legal obligations.

When using the Application, your Personal Data will be transferred to the United States, in which the privacy laws may not be as comprehensive as those in the country where you reside and/or are a citizen. We maintain measures to address the transfer of your Personal Data between us and our third-party providers in accordance with applicable data protection laws and regulations. Where we use certain service providers, we may use specific contracts approved by the European Commission which give your Personal Data the same protection it has in Europe.

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers. Any payment transactions will be encrypted.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Application, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Application. The information you share in public areas may be viewed by any user of the Application.

Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our Application. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

Changes to Our Privacy Policy

We may update our privacy policy from time to time. If we make material changes to how we treat our users’ personal information, we will post the new privacy policy on this page with a notice that the privacy policy has been updated.
